TVXQ to Stick Together Despite Legal Dispute

Three members of the pop group TVXQ ― Micky, Xiah and Hero ― said Monday that their recent legal action against their agency did not signal the disbanding of the group and they, along with members Max and U-Know, will keep their promise to fans to stick together.
In a legal document released through the law firm Kim & Shin, the three stated that their 13 year exclusive contract with SM Entertainment was no different from a binding lifelong contract. They also said that they were not treated fairly by the agency in terms of profit distribution.
The press release explained that they have been carrying out a vigorous schedule ever since their debut in 2004, flying between Japan, China and Korea with only three to four hours to sleep everyday.
``(They) have had health problems and finally reached their physical limits, but SM Entertainment continued to send them abroad and plan excessive activities. Thus, the three members have started to hope they will be able to continue their careers as they wish, instead of being used as tools for the agency's profits,'' the statement read.
It also said that the provisional disposition had nothing to do with the members' private business endeavors in the makeup industry, and was focused on the unfair contract.
``The contract period spans 13 years, and including military services, this can add up to almost 15 years. This is basically until we retire from the entertainment business. The contract also states that if we cancel the contract, even under agreement, we will have to pay several trillion won in penalties,'' the statement said.
The members were given 0.4 to 1 percent of total album sales following a revision of the contract in February. The initial contract stated that the members would be awarded 10 million won each if the previous album sold more than 500,000. If the albums were sold fewer than 500,000, the members would not receive anything.
The statement added that the three members tried to communicate with SM Entertainment, but the agency continually brought up the issue of their makeup business and avoided further settlements.
``SM Entertainment's attitude made them realize there was no hope in solving the situation through communication, and the members finally decided to take legal action to further settle the case.''
The members concluded the statement with a comment to their fans, saying that they ``were sorry for surprising and disappointing their fans.''
Micky, Xiah and Hero stirred fans and the industry by submitting the application for provisional disposition to terminate the validity of their contract to the Seoul Central District Court Friday.
SM Entertainment did not release a follow-up statement, but said that the band would continue performing and that it believed their career would continue.

The future of idol group DBSK is uncertain. DBSK's 3 members (Micky YooChun, Xiah Junsu, Youngwoong Jaejoong) and SM's trouble is too deep. Although they state that there will be no disbandment, in reality, disbandment is more than likely. Even if they avoid the worst case scenario, disbandment, it feels like their departure of SM is set.
On the third, a acquaintance of the 3 members said, "settlement with SM has been tried multiple times. But their differences couldn't be settled. The reason this went to court is because they couldn't find a point to settle." Thus, they concluded that more attempts for negotiations was useless.
The acquaintance that the reporter met is someone who has watched over DBSK very closely. He has experienced all ups and downs since debut until now. According to him, DBSK advocated for only one thing. They wanted conditions of the contract to be eased. However, it has gotten to a point where the conversations between the two parties have gone nowhere.
He stated, "they asked for the contract term and earnings distribution to be revised because everyone could tell it was irrational. They attempted to negotiate until the end but they felt that SM was avoiding them. Therefore, things got emotional for both parties and the 3 members are even more angry with SM's response."

After the initial reports about this incident, SM sent documents on the 1st and the 3rd. On the first, they reported that this problem was due to the makeup company investment and they will work it out. After the contract conditions were reported, they responded that members were paid 11 billion Won and were given foreign cars as presents.
In response to this, he stated, "the nature of this instance is the unfair contract, not the make up company. However, SM has not mentioned the contract conditions and have continued to use make up company issues to play with the media."
Additionally, he discussed about the 11 billion Won. He said, "let's say SM is right and that they were paid 11 billion won for the 6 years of work. This is the pre-tax profit. After taxes were paid, and this amount is divided by 6 years, and 5 members, this is less than 200 million won per member. For the first half of this year, the profits from album sales in Japan is 2.5 billion Yen (33 billion won). However, DBSK doesn't even receive 200 million won per year."
The total number of albums released in and outside of Korea is 48. Out of these, including singles and full albums, 1.96 million copies were sold in Korea. In Japan for 4 full albums and 27 singles, 8 of those sold over 100,000 copies, and one sold over 250,000 copies. Including south-east Asia, at least 4 million albums were sold.
He also criticized abnormal methods of calculating methods. According to him, "SM requested money for back dancers and food. Basically, almost all of the expenses were paid for by DBSK." He added, "besides this, SM created a local subsidiary and divided the earnings of DBSK into pieces. For example, SM Japan and Avex divided earnings, and this was also divided with Korean SM. With complex divisions, the money for the members were reduced.
Also, he stated that the foreign cars were given to them under the company's name. "They received cars from SM after an award ceremony. However, the cars were registered in SM's name and is not owned by DBSK."
"The three members are as tired as they can get."
According to this acquaintance, the three members of DBSK are tired of SM's play with the press. They have no intention to solve this with mere words, and are extremely upset that SM is exaggerating only one side of the story, distorting the truth. He said, "they expected SM to twist words with the press but didn't realize it would be to this extent. If SM continues this method, I think it would be nearly impossible to work together with SM again. I suspect that they will part with SM and try to find a different solution to settle this.
Their departure from SM does not mean the disbandment of DBSK. He asserts that there is no problems in relationships between all the members. They are still like family and agree that in any situations, they must work together. He said, "Truthfully, all five had the same intentions. But in the process of negotiations, there was differences between the members. That is why only 3 members decided to fight with their company. They all agree that the contract conditions are irrational, it is just that their way of handling it is different."
"DBSK will continue even after departure with SM"
Micky YooChun, Xiah Junsu, Youngwoong Jaejoong's will is stronger than ever. The acquittance reported that, "the 3 members are showing stronger wills than before debut. The three members are determined to stick together no matter what hardships come their way."
They are also determined to get back together as 5 members under the name DBSK. He revealed, "even if the 3 members leave SM through lawsuit, this only means departure from SM. This does NOT mean the disbandment of DBSK. It may be after the 2 remaining members leave, or if they perform from 2 different companies; the 5 want to continue with DBSK."
Well then, if 3 members leave SM, would they still be able to use the name 'DBSK.' Upon researching in the Industrial Property Office, the group name 'DBSK' is not registered. SM registered for DBSK trademark in 2004 but was denied. In other words, SM does NOT have the right to the name 'DBSK.'
According to a 'Mansung' Patent Law Firm Office, the patent attorney Hwang Sung Pil said, "Dong Bang means East and one cannot assert exclusive right to use it. Most likely, this was probably the reason why the application was denied 2004. SM cannot assert any trademark rights to the name. If the 5 members are together even away from SM, they will have no problems using the name."
More than anything, DBSK feels extremely sorry to their fans. This is why they want to go through with performances that were already scheduled. The acquaintance reported, "if they lose the lawsuit, they may have to pay an extreme amount of money for penalty. NEWS]KOREA'
Today is July 23rd, the start of the new copyright laws in Korea.
They have already started to hire people to monitor and enforce the new laws but the whole thing is still relatively unknown, no one really knows what constitutes a valid copyright infringement and what constitutes fair usage.
No one really knows how the 3 strikes policy is going to be monitored and enforced, or what the punishments are.
But good news for copyright holders, they now get MORE MONEY benefiting us all /sarcasm
i'll explain a bit further, under the new laws, the percentage given to copyright holders has now increased significantly (can't find the exact numbers right now but i'll post it when i find it).
This means there needs to be an increase in the cost of content to balance out the rest of the equation. i've heard numbers being thrown around of around 15% increase in the cost of CDs and so on. Nowcom seems to be using this as an excuse to make their mileage exchange program rather useless (This is in the Clubbox Tutorial Thread).
We won't really see the impact of these laws until they start enforcing them which could take atleast several weeks to several months, also since they have no power outside of Korea, not sure how they are planning to enforce these for foreign located servers.
There is also another issue popping up today and for the most part it's a big one.
It's the introduction and passing of the new 3 Media Laws in parliament.
The laws set out laws regarding IPTV and Media Company Ownership.
Big Point of contention being the ability for Newspaper companies and large corporation to own large stakes in Terrestrial Broadcasting Companies(MBC,
Currently all 3 Broadcasters are on strike and there is a good chance it's going to impact what programs are going to air this week.
But there is also a deeper social issue with these laws, Giving a newspaper or company decision making power in a broadcaster is going to start affecting what the broadcasters can and cannot do. This is huge issue and it means broadcasters who lose their impartiality when dealing with issues that don't agree with their owners, Newspapers in Korea tend to be very biased left or right wing and rarely neutral.
There is also the issue of legality since the laws passed through parliament rather hastily and without proper conduct, but that's beyond the scope of this post.
Anyway that sums up whats been happening in the world of Korean Media Law in the last 2 weeks.
Now how is this going to affect us?
-Depending on how long the protests go for, we won't seeing any new episodes of dramas and variety shows starting from next week onwards or even as early as Saturday (there goes my Infinity Challenge for this week -.-")
-Most likely there won't be a change in the copyright laws for awhile (3 years minimum because that's how long the current government has left in power)
-They are targeting primarily heavy uploaders and encoders of content so it remains to be seen how long Ental has left to live
-Public Korean Torrent sites are also under caution and uploaders are being cautious
-They are predicting that half of Korean Blogs and Cafes will shut down before years end
-Buying Content legally will also become more expensive due to increases in royalty for copyright holders
-Nowcom hasn't said anything about their future directions for clubbox, pdbox or afrecca yet but all 3 services seem to contradict the new laws so their future isn't very clear cut.
-Small recap of the copyright laws, parodies are illegal, posting a UCC/Youtube video of you using copyrighted content is now illegal(this includes personal reenactments of song sheets, singing, parodies etc), Blogs and Cafes are also forbidden from posting links to such content , Postings made prior to the 23rd are also considered illegal and they plan to search through community archives to find them, screen grabs from dramas and shows are illegal.
That's about it, the post was a bit long but i had a fair bit to cover.
Not really sure what the next step is for now, everyone seems to be taking a wait and see approach, no one knows how severely the government is going to enforce these laws and until then everyone is going to stay cautious.
They could also find a way to enforce their laws overseas but that seems unlikely, possible but unlikely.

It's just break my heart !!!!
Kim Min Soo from Korean group Monday Kiz lost his life early this morning in an motorbike accident. They just released their album a month ago on 31st March.
The incident happened this morning at 6:20am where the motorbike that Kim Min Soo was riding on crashed into a tree along the road. According to his management, he was immediately whisked off to Boramae hospital after the accident but was pronounced dead at 6:50am by doctors. His pillion rider who goes by the name of Lee suffered serious injuries.
Kim Min Soo had met with an accident last September involving his motorbike and was warded for four months in hospital. But this time, he couldn't escape death and makes one wonder what it might have been.
Can Entertainment representing Monday Kiz expressed, "Kim Min Soo had said after his accident last year that he wouldn't ride a bike again. I really can't believe that this had happened. I really don't know what else to say. We are awaiting the results from police investigations."

Korea’s renowned group, TVXQ, has become the President of the Republic of Korean Music. The virtual presidential elections, organized by MTV, started back on October 11th and lasted until December 11th. Among 30 candidates and having to be out of their home country for the whole year, the boys still managed to win 43.9% of the votes! Second place went to Jang Woo Hyuk, who is now serving in the military, and Big Bang. Because of this victory, MTV and Boombox (http://www.mtv.co.kr) declared December 23rd as “TVXQ Day” and will air special programs about the group!

Now the boys have another special day to celebrate along with their anniversary, which was on the 26th!! Their success just never seems to stop! The boys have once again conquered the Oricon Charts in Japan, coming in 3rd place with the song, “Together”. The boys will be releasing their 16th Japanese single, titled “Purple Line” on January 16th. Purple Line will also be included in their 3rd Japanese album, “T”, which will be released on January 23rd. Because of Koda Kumi’s popularity with releasing 12 singles in a row, their company in Japan, Avex Trax and Rhythm Zone (their label under Avex Trax), have decided to use the same strategy. Each single will have one members’ solo, making it a total of five singles. The title of this 17th single is yet to be determined. The boys have been working non-stop in Japan for the whole year and it seems like they won’t return to Korea just yet and the rumor of a 4th Korean album is still going around. Yesterday, my friend and I went backstage as reporters. I like Junsu and she likes Micky, so we went through a lot to get this opportunity to experience the real them.
When we reached, there was only half an hour till actual show time, and DBSK were already on stage, preparing to reherse. Their hair were not styled, and they all looked so normal, especially Junsu who looked just like a boy next door.
During the rehersal, the atmosphere was very light, everyone was talking and laughing. However, the director was unhappy with them and thus shouted for them to do it again. It scared me, but luckily, the boys didn't understand chinese. Once the music went on, the boys immediately went back to work attitude. Jaejoong was very straight forward(?), and when he heard the director shouting, even though he didn't know what the words meant, he probably thought that it was for them to start. He shouted at Yunho who was at the side to hurry get into place. When the music stopped halfway, he nagged loudly at Xiah(? No idea who Ah Xi is, so probably meant xiah) Rehersal was almost done, and the director said that there would be a five second break in between the two songs. (If I'm not wrong, the first song is Rising Sun and the second is O Jung ban Hap) Luckily the boys didn't know what the director said, if not they would definitely have been pissed. (I doubt so lol)
When it was the actual showtime, the boys had styled their hair with a lot of hairspray and the feeling was really different. They finished their first song. As both of these songs are dance numbers and have very tiring choreography, the five second break in between was definitely needed for them to at least catch their breath. However, the music of "O' started almost immediately, there wasn't the five second break at all. Yunho didn't even have time to react, but when he heard the music, he immediately went to his place and started dancing his solo. As we were standing at the side, we could see the boys' expressions really clearly. Changmin was staring at the other members in shock, Micky was furrowing his eyebrows due to exhaustion. It seemed as if all of them were already too overwhelmed, but they still had to finish dancing. Yunho was right in front for most of the time, and because he didn't want to disappoint the fans in front, he wanted to perfect his dance.
When the performance ended, they went backstage while the fans cheered loudly for them. However, reality was, when Yunho reached, he immediately kneeled down on the floor and started vomiting, Changmin sprawled himself on the floor, Jaejoong sat at a place where the fans couldn't see them, and Micky sat at a corner. All of them were panting really hard, and their pained expressions chilled our hearts. However, it seems that their managers and assistants were already used to this as they only asked if they were alright. Only junsu was still standing, saying something that probably meant I'm so tired, and the hairstylists immediately went up to him and started touching up on his hair. I know that junsu was also as tired as the other members, just that he couldn't break down like that, for he still had another song. When Sun Yue was already on stage, Junsu shouted for his microphone and immediately plastered a smile and went up on stage. I think that Junsu was probably giddy and unable to concentrate at that time. When Sun Yue wanted to sing with him, he totally didn't notice as he was too tired. It was very obvious from the side, the drops of sweat trickling down his face, and Junsu trying to wipe them away while singing his best.
When his performance ended, the other four members had to join him on stage for the closing, and even though they were smiling, when you know the truth, it pains your heart. The boys have really sacrified and given us so much, but all we can give them is the glamour and honour on stage. I know I shouldn't say this, but I don't want to like DBSK anymore, because I'm not worthy of it.

I want to be an invisible man
I really want to be an invisible man for one week to experience the things that are really
hard for me [to do] right now. One of these things would be travelling. If I'm an invisible
man, firstly, I can travel freely to the places that I want to visit and become a man of freedom.
With the ability to travel around the world, even thinking about it makes me incredibly excited.
At the same time, I would not miss out on a single musician that I admire, whether they reside in
Korea or elsewhere. I would definitely go pay them a visit. They have received the public's
affirmation as musicians and the things they don't reveal would only be their individual techniques
and the hard work they have put forth. All of this would be a big help in my becoming the musician
I have dreamed of (laugh). At the same time, I want to give hope to those who really need help from
others, especially those whose dreams have stumbled across a blockade and are in desperate situations
in which they can only give up. This is because I have dreamed of becoming a singer starting from a
long time ago. In order to make this dream come true, there's no one better than me who knows the
amount of hard work one has to put forth. Even though one would feel that one is willing to face
anything for the sake of reaching one's dream, there are times when one would feel tired and find it
tough. One may feel downtrodden and want to give up... [So, I] want to encourage those who are in this
tired state; [I] want to help them to be able to press onward from here on.

Through magical performances, let everyone enjoy a time of happiness
It'd be so good if our performances can frequently add in the element of magic. If those who are having
a hard time due to studying or those who are in pain due to love come to watch our shows, even if it's
only a moment of releasing their anxieties, it'd be such a wonderful thing. The fans who come to watch
our shows as well as us members can feel the happiness and excitement. When they're watching our electrifying
dances and listening to our songs, the audience is basking in a world of happiness during this time. Just like
they've fallen into a magical trance! After seeing their sparkling eyes, perhaps I will perform without the
knowledge of fatigue. I truly believe that those who are watching us on stage right now can also feel
a bit of happiness, a bit of joy! I also hope it will continue like this in the future. Those fans who have
come to see our performances and in turn worked harder to study, when I heard the fans chatting excitedly and
happily, I will unknowingly become charged with intense ambition. [I look] really cool like that, right? During
our performances, illusions are displayed through the use of "magic" at certain moments. [This could be referring
to special effects during shows; I'm not sure.] As a result, TVXQ members can also re-energize. And even if our
energy has depleted because of this, when we stand on stage, we can convey our energy at any time. [I think this
means no matter how tired they are, they will still perform with power and energy on stage. ^^V]

Please give me the power to fly in the sky
Magic... When you think about it, it's a really happy word. Just like birds that can fly in the sky, and
like Peter Pan who can forever retain his current self, it's like these intricate miracles can really turn
into reality. If I can really be so lucky, just like Peter Pan who has the power to fly in the sky, that'd be
great. At the end of a day's schedule when everyone has fallen asleep, I would think about wanting to fly. How
much hidden pain would this cause? I can also fly back to Korea's home in a short time (laugh). Maybe the sight
of watching the night sceneries would be different than the view from riding a bus. How similar would it be?
[This sounds strange to me and I don't know if it's a mistake in the original translation; maybe it should be
"different" instead of "similar", or maybe Jaejoong's wondering there could possibly be some similarities despite
the differences.] The buses that are on the streets would be like toys. The stars will also be by my side,
sparkling brightly. Clouds would also be like soft wool caressing my cheeks. Maybe I'd even get to meet Superman or
Spiderman... This can happen, right? Hahaha... Seems like I've gone on a tangent. Even if this cannot come true,
it's ok. Just thinking about it makes me very happy.

I want to have a magic book that records everything
"If there's something magical that has happened in my surroundings?" Sounds like it's a very broad question (laugh).
I really want to think about this all of a sudden, but I couldn't think of anything. From when I was younger
till now, once in a while I would think about what would happen if something like this were to occur. Let's start
from the conclusion. It's a magic book. Just like a regular book, the size would be convenient to carry around.
The pages inside would be blank. When watching others showing magic tricks, in the book that contains nothing, if I
drew a pigeon [on the blank page], then a pigeon will fly out [from the book]. But the magic book that I want is not
one where pigeons can fly out. When you hold the book in your hand, you can then know what one's mind is thinking.
If there's a book that you want to read, you just have to think about it, open the magic book, and the contents you had
envisioned would appear. Ummm... If the things that I want can appear once they're drawn in the book, that'd be
great (laugh). When I suddenly have a book I want to read or something that I want to understand but I can't get right
away, then I'll forget [about these things] at this time. Or it'd be quite a while before I remember [them] again.
Perhaps when someone beside me said something, then I would go "aigoo" when it suddenly jogged my memory about
something. At these times, if there's such a magic book, the book I want to read can appear and the things I want to
understand will be known. This kind of feeling is very good. Ah! It's also just as happy as a movie. The images of
happy memories are all stored in the [magic] book. The best would be to open the [magic] book occasionally and can see
these things. When we perform, we cannot take pictures of ourselves. We can [only] take pictures of the fans. When
things get tough, if we see the fans' encouragement, then we will get our energy back (laugh). After saying all this,
it seems that it's like an all-purpose notebook. Would there really be nothing like this type of computer or electronic
device in the future? You don't need to type or do a search, all you need is a screen to see all the things that you wish
for. I really want to have this kind of incredible magic book (laugh).

I want to see the future me more quickly
I want to ride the time machine to the future me ten years from now. I've had this thought for the past ten years.
I've had goals. Now that I've become an artist, whenever I think about what I'll be like ten years from now,
my heart will beat fast. Ten years from now, I'll be 32. Right now, I have two biggest goals. One is to grow and
become a real musician. The other is to become an exemplary father just like my father. My goal is to become a
musician who is affirmed in my own country and abroad; to create music that no one else can imitate and only
contains my distinct style. In addition, my music can have the power to give inspiration to everyone in the world.
I want to become such a musician. All along, my father is the person whom I most respect. If I can also be a father
that my child/children can be proud of, that'd be great. Whether it's music or family, I don't want to lose either aspect.
I'm living a very fruitful reality. The future will definitely be the way I have envisioned it. I will work hard in
passing the days of my life in preparation for what is to happen ten years from now.
